Incide o art. 395 da CLT. DANOS MORAIS – CONFIGURA\u00c7\u00c3O A ocorr\u00eancia de aborto espont\u00e2neo com20\/21 semanas de gesta\u00e7\u00e3o e a dispensa da Reclamante sem justa causa, por si s\u00f3, n\u00e3o ensejam abalo aos direitos de personalidade capaz de justificar repara\u00e7\u00e3o pela Reclamada. HONOR\u00c1RIOS ADVOCAT\u00cdCIOS – PERDAS E DANOS \u2013 ARTIGO 389 DO C\u00d3DIGO CIVIL Na Justi\u00e7a do Trabalho, a contrata\u00e7\u00e3o de advogado particular \u00e9 mera faculdade do reclamante, inexistindo preju\u00edzo causado pela reclamada capaz de ensejar a repara\u00e7\u00e3o prevista no artigo 389 do C\u00f3digo Civil. Assim, permanecem imprescind\u00edveis \u00e0 concess\u00e3o de honor\u00e1rios advocat\u00edcios os requisitos da Lei n\u00ba 5.584\/70. S\u00famulas nos 219 e 329 desta Corte.
