EMENTA<\/strong><\/p>\n

HONOR\u00c1RIOS EXTRAJUDICIAIS. RESSARCIMENTO DE DESPESAS COM A CONTRATA\u00c7\u00c3O DE ADVOGADO. DIREITO \u00c0 PARCELA NO \u00c2MBITO DA JUSTI\u00c7A DO TRABALHO. A despeito da exist\u00eancia do jus postulandi (artigo 791\/CLT), n\u00e3o se pode negar ao empregado a contrata\u00e7\u00e3o de advogado de sua confian\u00e7a para patrocinar seus interesses de forma profissional, o que consolida o direito constitucional de acesso \u00e0 Justi\u00e7a e atende ao princ\u00edpio da ampla defesa. Tendo o trabalhador de se valer da contrata\u00e7\u00e3o de advogado para propor a\u00e7\u00e3o judicial com o intuito de receber parcelas decorrentes de direitos que n\u00e3o foram observados durante o per\u00edodo contratual, deve ele ser ressarcido dos referidos gastos, nos termos dos artigos 186, 389, 404 e 944 do C\u00f3digo Civil.
