RECURSO DE REVISTA ASS\u00c9DIO MORAL. DANO MORAL. PRETENS\u00c3O DE MAJORA\u00c7\u00c3O DO VALOR DA INDENIZA\u00c7\u00c3O. O Tribunal Regional reconheceu o dano moral decorrente de ass\u00e9dio moral, mas reduziu o quantum arbitrado na senten\u00e7a (R$100.000,00) para R$20.000,00. Sopesou: o objetivo de compensar a v\u00edtima pelo dano sofrido e punir o infrator, a considera\u00e7\u00e3o das condi\u00e7\u00f5es econ\u00f4micas e sociais das partes envolvidas, a gravidade da falta cometida e o grau de culpa do ofensor. Entendeu que o valor arbitrado n\u00e3o pode constituir san\u00e7\u00e3o irris\u00f3ria, nem implicar enriquecimento sem causa para a v\u00edtima, assegurando-se a natureza punitiva, tendo em vista o limite do razo\u00e1vel. N\u00e3o se constata ofensa direta e literal do artigo 5\u00ba, V e X, da Constitui\u00e7\u00e3o Federal, visto que o ac\u00f3rd\u00e3o recorrido demonstra a observ\u00e2ncia do crit\u00e9rio da proporcionalidade para impor uma restaura\u00e7\u00e3o justa, considerando a perspectiva econ\u00f4mica das partes, fixando-se valor razo\u00e1vel para a hip\u00f3tese, inclusive, comparativamente a outros julgados desta Corte que envolvem ass\u00e9dio moral em raz\u00e3o da mesma reclamada.
