AGRAVO INTERNO NO AGRAVO EM RECURSO ESPECIAL. PROCESSUAL CIVIL. AUS\u00caNCIA DE PREQUESTIONAMENTO. REEXAME DE PROVAS. S\u00daMULAS N\u00baS 7<\/a> E 211<\/a> DO SUPERIOR TRIBUNAL DE JUSTI\u00c7A.<\/p>\n 1. A falta de prequestionamento da mat\u00e9ria suscitada no recurso especial, a despeito da oposi\u00e7\u00e3o de embargos declarat\u00f3rios, impede seu conhecimento, a teor da S\u00famula n\u00ba 211<\/a> do Superior Tribunal de Justi\u00e7a.<\/p>\n 2. A reaprecia\u00e7\u00e3o da conclus\u00e3o do aresto impugnado encontra \u00f3bice, no caso concreto, na S\u00famula n\u00ba 7<\/a> do Superior Tribunal de Justi\u00e7a.<\/p>\n 3. Segundo jurisprud\u00eancia pac\u00edfica, a incid\u00eancia das S\u00famulas n\u00bas 7<\/a> e 211\/STJ<\/a> obsta o seguimento do recurso por qualquer das al\u00edneas do permissivo constitucional.<\/p>\n 4.
