HIP\u00d3TESE DE ADES\u00c3O A PROGRAMA DE PARCELAMENTO. PRESCRI\u00c7\u00c3O VOLTA A FLUIR NO MOMENTO DO INADIMPLEMENTO DA PARCELA. IRRELEV\u00c2NCIA DA DATA DA INTIMA\u00c7\u00c3O DO CONTRIBUINTE RELATIVA A EXCLUS\u00c3O DO REFIS. INCID\u00caNCIA DA S\u00daMULA N. 83\u2044STJ<\/a>.<\/p>\n I \u2013 A jurisprud\u00eancia desta Corte considera que quando a argui\u00e7\u00e3o de ofensa ao dispositivo de lei federal \u00e9 gen\u00e9rica, sem demonstra\u00e7\u00e3o efetiva da contrariedade, aplica-se, por analogia, o entendimento daS\u00famula n. 284<\/a>, do Supremo Tribunal Federal.<\/p>\n II \u2013 \u00c9 pac\u00edfico o entendimento no Superior Tribunal de Justi\u00e7a segundo o qual a prescri\u00e7\u00e3o tribut\u00e1ria, na hip\u00f3tese de ades\u00e3o a programa de parcelamento, volta a fluir no momento do inadimplemento da parcela, sendo irrelevante a data da intima\u00e7\u00e3o do contribuinte relativa a exclus\u00e3o do REFIS.<\/p>\n III – O recurso especial, interposto pelas al\u00edneas a e\u2044ou c, do inciso III, do artigo 105<\/a>, da Constitui\u00e7\u00e3o da Rep\u00fablica, n\u00e3o merece prosperar quando o ac\u00f3rd\u00e3o recorrido encontra-se em sintonia com a jurisprud\u00eancia desta Corte, a teor da S\u00famula n. 83<\/a>.<\/p>\n IV \u2013 A Agravante n\u00e3o apresenta, no regimental, argumentos suficientes para desconstituir a decis\u00e3o agravada.<\/p>\n V \u2013 Agravo Regimental improvido.<\/p>\n (STJ – Agrg no Agravo em Recurso Especial n\u00ba 618.723 – PE (2014\u20440302234-7) – Rel.
