Nos termos do art. 249, \u00a7 2\u00ba, do CPC, fica superada a preliminar de nulidade. ACIDENTE DE TRABALHO. INDENIZA\u00c7\u00c3O POR DANOS MORAIS E MATERIAIS. DECIS\u00c3O RECORRIDA QUE RECONHECE A RESPONSABILIDADE SUBSIDI\u00c1RIA DA EMPRESA TOMADORA DE SERVI\u00c7OS. PEDIDO DE RECONHECIMENTO DA RESPONSABILIDADE SOLID\u00c1RIA. Deve ser provido o agravo de instrumento para melhor exame do recurso de revista por prov\u00e1vel afronta ao art. 942 do CCB.
