AGRAVO REGIMENTAL NOS EMBARGOS DE DECLARA\u00c7\u00c3O NO RECURSO ESPECIAL – A\u00c7\u00c3O CONDENAT\u00d3RIA (COBRAN\u00c7A DE DESPESAS CONDOMINIAIS) – DECIS\u00c3O MONOCR\u00c1TICA QUE NEGOU SEGUIMENTO AO APELO EXTREMO.<\/p>\n

INCONFORMISMO DA R\u00c9.<\/p>\n

1. Viola\u00e7\u00e3o ao artigo 535<\/a>, do C\u00f3digo de Processo Civil, n\u00e3o configurada. Ac\u00f3rd\u00e3o estadual que enfrentou todos os aspectos essenciais \u00e0 resolu\u00e7\u00e3o da controv\u00e9rsia de forma clara e fundamentada.<\/p>\n

2. A altera\u00e7\u00e3o do aresto hostilizado, pelos fundamentos expostos nas raz\u00f5es do especial – acerca da ci\u00eancia inequ\u00edvoca do condom\u00ednio, de modo a se aferir a legitimidade da parte para responder pelos d\u00e9bitos condominiais -, exige o revolvimento do acervo f\u00e1tico-probat\u00f3rio dos autos, provid\u00eancia vedada pela S\u00famula n.7<\/a> do STJ.<\/p>\n

3. Agravo regimental desprovido.<\/p>\n
