1. Descabimento de a\u00e7\u00e3o rescis\u00f3ria ante o n\u00e3o preenchimento dos requisitos impostos pelo artigo 485<\/a>do CPC, mais especificamente, a exist\u00eancia de decis\u00e3o que tenha examinado o m\u00e9rito da controv\u00e9rsia.<\/p>\n 2. No caso, o julgado rescindendo foi a decis\u00e3o prolatada no EREsp 1.357.549\u2044SP, sendo certo que o recurso especial foi inadmitido em virtude de erro no preenchimento dos c\u00f3digos nas guias de recolhimento; enquanto os embargos de diverg\u00eancia foram indeferidos liminarmente em raz\u00e3o da aus\u00eancia de demonstra\u00e7\u00e3o do diss\u00eddio jurisprudencial e, subsidiariamente, de incid\u00eancia da S\u00famula 168<\/a>do STJ.<\/p>\n 3.
