A 10\u00aa C\u00e2mara de Direito Privado do Tribunal de Justi\u00e7a de S\u00e3o Paulo julgou procedente recurso para reconhecer o direito real de habita\u00e7\u00e3o a vi\u00fava, negando a desocupa\u00e7\u00e3o do im\u00f3vel.<\/p>\n
De acordo com os autos, o falecido vivia no local com a companheira \u2013 fruto de seu segundo casamento \u2013 h\u00e1 20 anos. Ap\u00f3s sua morte e com a extin\u00e7\u00e3o do usufruto do bem, a vi\u00fava continuou no im\u00f3vel e ajuizou a\u00e7\u00e3o contra o esp\u00f3lio, pleiteando reconhecimento do direito real, que foi julgada extinta em raz\u00e3o de litispend\u00eancia.<\/p>\n
