\nAGRAVO DE INSTRUMENTO – A\u00c7\u00c3O COMINAT\u00d3RIA DE OBRIGA\u00c7\u00c3O DE FAZER – PLANO DE SA\u00daDE – CIRURGIA \u2013 IMPLANTE DE PR\u00d3TESE PENIANA – NECESSIDADE DEMONSTRADA – DIREITO CONSTITUCIONAL \u00c0 SA\u00daDE – PRESEN\u00c7A DOS REQUISITOS DO ART. 273 DO CPC \u2013 ANTECIPA\u00c7\u00c3O DA TUTELA \u2013 MEDIDA QUE SE IMP\u00d5E \u2013 MULTA DI\u00c1RIA \u2013 CRIT\u00c9RIOS \u2013 RAZOABILIDADE E PROPORCIONALIDADE. – O procedimento cir\u00fargico para implanta\u00e7\u00e3o de pr\u00f3tese peniana deve ser autorizado em sede de tutela antecipada, se verificada a prova inequ\u00edvoca da verossimilhan\u00e7a das alega\u00e7\u00f5es e o fundado receio de dano irrepar\u00e1vel ou de dif\u00edcil repara\u00e7\u00e3o, ainda que exista cl\u00e1usula restritiva contida em contrato de ades\u00e3o, considerada a garantia constitucional do direito \u00e0 sa\u00fade. – A multa estabelecida para o descumprimento de obriga\u00e7\u00e3o de fazer deve obedecer aos princ\u00edpios da razoabilidade e proporcionalidade e ser compat\u00edvel com a obriga\u00e7\u00e3o determinada, sob pena de constituir fonte de enriquecimento sem causa.
