\n1.<\/strong>\u00a0A contradi\u00e7\u00e3o ensejadora de embargos declarat\u00f3rios somente \u00e9 aquela ocorrida no bojo do julgado impugnado, ou seja, a discrep\u00e2ncia existente entre a fundamenta\u00e7\u00e3o e a conclus\u00e3o.
\n2<\/strong>. Equipara-se \u00e0 gest\u00e3o de neg\u00f3cios a presta\u00e7\u00e3o de alimentos feita por outrem na aus\u00eancia do alimentante. Assim, a pretens\u00e3o credit\u00edcia ao reembolso exercitada por terceiro \u00e9 de direito comum, e n\u00e3o de direito de fam\u00edlia.
\n3<\/strong>. Se o pai se esquivou do dever de prestar alimentos constitu\u00eddos por t\u00edtulo judicial, onerando agenitora no sustento dos filhos, n\u00e3o \u00e9 a execu\u00e7\u00e3o de alimentos devidos o meio apropriado para que ela busque o reembolso das despesas efetuadas, devendo faz\u00ea-lo por meio de a\u00e7\u00e3o pr\u00f3pria fundada no direito comum.
